A few days ago the new movie "Itaewon homicide", of which script is said to be based on the real-life story that a unversity student, whose family was in need, was killed in the batheroom of hamburger store in Itaewon Seoul but courts detected two suspects who were with him in batheroom, could not find out the criminal, namely the two suspects were not guilty, was released.
Two suspects whose names were Pierson and Alex, having the nationality of U.S, were teenager students. Aside from the incompetence of Korean government that could not conserve the spot of the crime and the arbitrariness of U.S. government to Korean people and the animosity of Korean people to the U.S government, what I intend to say is the fact that though a crime happened in the isolated area, as like a batheroom, and undoubtedly the killers were there, the courts could not find out the criminal. How is that possible?
I think, it is possible, even though it is hard to accept, in the consideration of the feature of "Actual Truth". It should be kept in mind that the existence of the actual truth and the discovery of the actual truth are totally different. In that case, Pierson who CID of U.S took for the criminal of the homicide and transfered to Korean government, said to the Korean prosecutor that I didin't kill him and Alex killed him.
The problem is that Alex reiterated what Pierson said, namely "I didin't kill him and Pierson killed him" and the more problem is that the most stupid and incapable Korean police didn't preserve the scene of the crime. Alex and Pierson passed the buck to each other, but the prosecutor could not dig out the criminal, moreover the courts also didn't reveal who the criminal was.
After all, two suspects were released, just saying "We killed him, but I didn't"
That case reveals what the system of justice of government is. From the perspective of the right wing, it seems to be good and coincident to the concept of the justice in that if the courts can not disclose the real criminal, despite a strong conviction, the suspects should be not judged "guilty".
However, from the other perspective, it gives the strong evidence to the contrary that our judicial system is something wrong, or there is big loopehole, in protecting the unprivileged. The important thing is not that actual truth exists, but that actual truth can not be revealed forever. In that case, let us suppose that Alex and Pierson killed him together.
However I tried to, till now I am more entralled with the word of Malcom X, "Anger is gift" rather than the words in the constitutional law "everyone is equal in front of the law"
